NOTICE OF EXCHANGE OF REAL PROPERTY
FOR THE TOWN OF NEW ROSS, INDIANA
The Town Council of the Town of New Ross, Indiana, as a disposing agent of real
property, gives notice, pursuant to Ind. Code § 36-1-11 and Ind. Code § 5-3-1 of the
exchange of the following real property:
Tract A, containing 0.541 acres, more or less, owned by the Town of New Ross,
Indiana, more particularly described as follows:
Part of the Northeast Quarter of the Northwest Quarter of Section Thirty-six
(36), Township Eighteen (18) North, Range Three (3) West, Walnut Township,
Montgomery County, Indiana, more particularly described as follows: Beginning at a
5/8” x 24” capped rebar marked “DECKARDSURVEY LIC#20000203” (hereinafter
referred to as a Deckard rebar) 336.50 feet North 00 Degrees 13 Minutes 33
Seconds East and 223.61 feet North 65 Degrees 56 Minutes 53 Seconds East of
an uncapped rebar marking the Southwest corner of said Northeast Quarter of the
Northwest Quarter; THENCE North 00 Degrees 13 Minutes 33 Seconds East 30.22
feet to the approximate centerline of James Harris Legal Drain; THENCE North 65
Degrees 41 Minutes 58 Seconds East along said centerline 805.85 feet; THENCE
leaving said centerline and running South 00 Degrees 13 Minutes 33 Seconds West
34.06 feet to a Deckard rebar; THENCE South 65 Degrees 56 Minutes 53 Seconds
West 804.26 feet to the place of beginning, containing 0.541 acres (23563.300 sq.
ft.), more or less.
Subject to a 75-foot easement from the top of bank for the James Harris
legal drain. Also, together with and subject to all other rights of way, covenants,
easements and restrictions of record.
Surveyor’s Note: The above tract is intended to transfer to the owner of adjacent real
estate. This adjacent real estate currently has access to a public right of way. This tract
shall be considered “land locked” if this condition is not met.
Tract B, containing 0.774 acres, more or less, owned by Larry & Violet Hackett, more
particularly described as follows:
Part of the Northeast Quarter of the Northwest Quarter of Section Thirty-six
(36), Township Eighteen (18) North, Range Three (3) West, Walnut Township,
Montgomery County, Indiana, more particularly described as follows: Beginning
at a magnetic nail in the approximate centerline of County Road 500S, 343.48
feet South 00 Degrees 13 Minutes 33 Seconds West and 937.00 feet South 89
Degrees 17 Minutes 55 Seconds East of a stone marking the Northwest corner
of said Northeast Quarter of the Northwest Quarter; THENCE South 89 Degrees
17 Minutes 55 Seconds East along said centerline 380.88 feet to a magnetic nail
at the approximate centerline intersection of County Road 500S and the James
Harris Legal Drain; THENCE leaving said centerline of County Road 500S and
running South 65 Degrees 41 Minutes 58 Seconds West along said centerline of the
James Harris Legal Drain 418.64 feet to a point witnessed by a 5/8” by 24” capped
rebar marked “DECKARDSURVEY LIC#20000203” 19.94 feet North 00 Degrees
13 Minutes 33 Seconds East; THENCE leaving said centerline and running North
00 Degrees 13 Minutes 33 Seconds East 176.94 feet to the place of beginning,
containing 0.774 acres (33695.646 sq. ft.)., more or less.
Subject to a right of way for County Road 500S along the most northerly boundary
of the above described 0.774 acre tract. Also, subject to a 75-foot easement from the
top of bank for the James Harris Legal Drain. Also, together with the subject to all
other rights of way, covenants, easements and restrictions of record.
Tract A will be exchanged for Tract B, with the property being conveyed to be full
payment for the property being received.
Tract A is not being sold or exchanged with a person who is ineligible under Ind. Code
§ 3-1-11-16, and is also not being sold or exchanged with a governmental entity.
Both Tract A and Tract B have been appraised by two (2) appraisers who meet the
following criteria: an appraiser professionally engaged in making appraisals; an appraiser
licensed under Ind. Code § 25-34.1; or an appraiser who is an employee of the political
subdivision familiar with the value of the property. Tract A and Tract B have both been
determined to have little to no value by both appraisers.
Tract A will be exchanged for Tract B no earlier than July 2, 2019.
