A Crawfordsville man has been charged with two counts of incest, a level 5 felony, after the alleged victim spoke with sheriff’s deputies earlier this month.
David Franklin Newkirk, 70, is accused of forcing an adult female relative to have intercourse with him on two occasions in March 2017 at his home, according to a probable cause affadavit filed Monday in Montgomery Circuit Court.
Court documents revealed the alleged victim sought treatment for unrelated medical issues, and then began undergoing counseling related to the sexual assault. Acting upon her counselor’s suggestion to expand on the events with members of her immediate family, she “eventually admitted to her husband that she had been violated,” the affidavit states. In it, she described her use of the term force as “verbal persistence of telling her to have sex with him.”
Montgomery County Sheriff’s Detective Travis King Deputy Michael Kersey interviewed the alleged victim and Newkirk. Information provided by both parties appeared consistent and served as evidence to request a warrant for Newkirk’s arrest Wednesday.
He has since posted a $2,000 cash bond and was released from the Montgomery County Jail.
